With this privacy policy, InnoPlastics AG informs you about which personal data we process in connection with our activities and operations. In particular, we provide information on why, how and where we process personal data, how long the personal data is stored and whether personal data is passed on to third parties in Switzerland and abroad. 2. terms and legal bases

2.1 Definitions

Personal data is any information relating to an identified or identifiable person. A data subject is a person about whom personal data is processed. Processing includes any handling of personal data, regardless of the means and procedures used, in particular the storage, disclosure, procurement, deletion, storage, modification, destruction and use of personal data.

2.2 Legal bases

We process personal data in accordance with Swiss data protection law, in particular the Federal Act on Data Protection (FADP), the Ordinance to the Federal Act on Data Protection (OFADP) and, if and insofar as the General Data Protection Regulation (GDPR) is applicable, the personal data in accordance with at least one of the legal bases in Art. 6 GDPR and accordingly in accordance with the revDPA.

We process the personal data required to carry out our activities and operations in a permanent, user-friendly, secure and reliable manner. Such personal data may fall into the following categories in particular

  • Browser and device data
  • Content data, meta or marginal data and usage data

The personal data we collect is only stored for as long as is necessary to fulfill the respective purpose. Under certain circumstances, legal requirements or other obligations may lead to longer storage. Personal data that no longer needs to be processed will be anonymized or deleted.

We may have personal data processed by third parties. We may also process personal data jointly with third parties or transfer it to third parties. Such third parties are, in particular, specialized providers whose services we use.

In principle, we only process personal data with the consent of the data subject, unless the processing is permitted for other legal reasons, for example to fulfill a contract between the data subject and the controller or for corresponding pre-contractual measures to protect our overriding legitimate interests, because the processing is evident from the circumstances or after prior information.

In particular, we process information that a data subject has voluntarily provided to us when contacting us - for example by post, email or telephone. We process this information only to the extent necessary to fulfill the purpose of the processing or to complete the order. If mandatory fields are marked when completing forms, these are required to fulfill your request. If we receive data about other persons, the transmitting persons are obliged to guarantee data protection for such persons and to ensure the accuracy of such personal data.

3.3 Categories of recipients of personal data

As part of our business activities, we work with various suppliers and service providers who may have access to certain personal data. These recipients may be, for example

  • Suppliers who are responsible for shipping processing or logistics
  • Service providers who provide our IT infrastructure or cloud services
  • External consultants or partners who support us in certain processes

We select our suppliers and service providers carefully and ensure that they take appropriate security precautions to guarantee the confidentiality and security of your data.

4.1 Cookies

Cookies may be used on the website to enable certain functions and to make visiting the website more attractive for users. These are small text files that are stored on your computer. When you access our website, we may collect the following information, provided that it is transmitted by your browser to our server infrastructure or can be determined by our web server:

  • Operating system including user interface and version;
  • Browser including language and version;
  • individual sub-pages of our website accessed, including the amount of data transferred;
  • the last website accessed in the same browser window (referrer).

We store such information, which can also be qualified as personal data, as server log files. The information is required to provide our website in a permanent, user-friendly and reliable manner and to ensure data security and thus in particular the protection of personal data - also by third parties or with the help of third parties.

4.3 Tracking pixels

We may use tracking pixels on our website. Tracking pixels are also known as web beacons. Tracking pixels - including those from third parties whose services we use - are small, usually invisible images that are automatically retrieved when you visit our website. Tracking pixels can be used to collect the same information as server log files.

4.4 Children

Our website is not intended for children and we do not knowingly collect personal data from children under the age of 16 unless we have the express consent of their parents. 5 SSL/TLS encryption

This website uses SSL/TLS encryption for security reasons and to protect the transmission of confidential content, such as requests that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

 

 

6 Third-party services

To ensure the user-friendliness, security and reliability of our website, we use plugins from third-party providers who have either helped to create the design in the background or who actively offer certain functions for users on the website. We only use plugins and other services from third parties if this is beneficial to the user experience. We use the plugins listed below, although not all of these plugins process personal data.

6.1 Social media

We may be present on social media platforms and other online platforms in order to communicate with interested parties and provide information about our activities and operations. These sites and services are offered and operated by third parties. Each of these sites has its own data protection provisions.

In connection with such platforms, personal data may also be processed outside Switzerland and the European Economic Area (EEA).

InnoPlastics AG has no influence on how the data is collected or used by such operators. It also has no influence on the extent to which, where and for how long the data is stored, to what extent they comply with any existing deletion obligations, what evaluations and links they make with the data. InnoPlastics AG does not know to whom the third-party providers pass on this data.

 

6.2 Hosting

We use third-party services in order to be able to make use of the digital infrastructure required in connection with our activities and operations. This includes, for example, our hosting provider.

6.3 Google Workspace

If you contact us by email, these emails will be linked to a Google Workspace. This service is provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. However, data may also be transferred to Google servers in the USA and stored there.

The legal basis for the use of Google Workspace is our legitimate interest in the economic operation of our online offering and the consent of the person using it (Art. 6 para. 1 lit. a and f GDPR).

For the transfer of data to the USA, the decision of the EU Commission (2023/4745) of July 10, 2023 with regard to the so-called EU-U.S. Data Privacy Framework (DPF) ensures that the data in these countries receives protection equivalent to that of the EU/EEA area.

6.4 Google Fonts

On our website we use Google Fonts, also known as "Google Fonts" from Google Inc. Google Ireland Limited (Gordon House, Barrow Street Dublin 4, Ireland) is responsible for the European area. The use of Google Fonts does not require a login or password. No cookies are stored in your browser. The fonts (CSS, Fonts) are requested from the Google domains fonts.googleapis.com and fonts.gstatic.com. These requests are separate from other Google services. If you have a Google account, your account data will not be transmitted while using Google Fonts.

Google Fonts offers over 800 fonts for free, some under the SIL Open Font License and others under the Apache license. These are optimized for the web and improve the loading time of our site. Google Fonts supports common browsers and mobile operating systems.

When you visit our website, the fonts are loaded from a Google server, which transmits data to Google, including your IP address. The Google Fonts API minimizes the collection of user data to what is necessary.

Google stores CSS requests for one day outside the EU and font files for one year. This improves the website loading time, as the fonts are stored temporarily. You cannot delete this data yourself. To delete them, contact Google support.

6.5 Google Maps

Our website uses Google Maps from Google Inc., whereby Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) is responsible for European users. Google Maps enables us to display locations precisely and to adapt our service to your needs. Please note, however, that when you use Google Maps, data is transferred to Google and stored on its servers.

Google Maps is a map service that allows you to search for locations, places of interest, accommodation and businesses online. Companies that are present on Google My Business can display additional information. To display locations on websites, map sections can be embedded using HTML code. Google Maps offers street maps, satellite images and Street View for precise representations.

Our aim is to provide you with useful information on our website. The integration of Google Maps enables us to provide important location data, including our company headquarters and directions for various means of transportation. Please note that Google must collect and store data from you, including search terms, IP addresses and geographical coordinates, in order to provide Google Maps.

Google sets at least one cookie (NID) in your browser to store your user behavior and provide personalized advertising. You can manage and deactivate cookies, and we cannot guarantee the completeness of the stored data. NID is used by Google to customize advertisements to your Google searches. With the help of the cookie, Google "remembers" your most frequently entered search queries or your previous interaction with ads. So you always get customized ads. The cookie contains a unique ID that Google uses to collect your personal settings for advertising purposes. Expiration date: after 6 months.

Most Google servers are located in the USA, which raises data protection issues. Google uses standard contractual clauses to ensure European data protection standards. Google stores some data for a certain period of time and anonymizes other data, such as advertising data, in server logs. You can delete location and activity data in your Google account and deactivate location tracking.

The legal basis for data processing when using Google Maps is your consent (Art. 6 para. 1 lit. a GDPR) or our legitimate interest (Art. 6 para. 1 lit. f GDPR), provided you have given your consent.

6.6 Google Tag Manager

We use the service called Google Tag Manager from Google. "Google" is a group of companies and consists of the companies Google Ireland Ltd (provider of the service), Gordon House, Barrow Street, Dublin 4, Ireland and Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA and other affiliated companies of Google LLC.

The Tag Manager itself is a domain that does not set any cookies and does not store any data. It acts as a mere "administrator" of the implemented tags. The data is recorded by the individual tags of the various web analysis tools. In the Google Tag Manager, the data is passed through to the individual tracking tools and is not saved.

However, the situation is completely different with the integrated tags of the various web analysis tools, such as Google Analytics. Depending on the analysis tool, various data about your web behavior is usually collected, stored and processed with the help of cookies. Please read our data protection texts for the individual analysis and tracking tools that we use on our website.

In the account settings of the Tag Manager, we have allowed Google to receive anonymized data from us. However, this only concerns the use and utilization of our Tag Manager and not your data, which is stored via the code sections. We allow Google and others to receive selected data in anonymized form. We therefore consent to the anonymous sharing of our website data. Despite extensive research, we were unable to find out exactly which summarized and anonymous data is forwarded. In any case, Google deletes all information that could identify our website. Google combines the data with hundreds of other anonymous website data and creates user trends as part of benchmarking measures. Benchmarking involves comparing our own results with those of our competitors. Processes can be optimized on the basis of the information collected.

6.7 Google Analytics

We use the service called Google Tag Manager from Google. "Google" is a group of companies consisting of Google Ireland Ltd (provider of the service), Gordon House, Barrow Street, Dublin 4, Ireland and Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA and other affiliated companies of Google LLC.

We use Google Analytics on the basis of our legitimate interests to analyze and regularly improve our website and to use the statistics obtained to regularly improve our offer and make it more interesting for you. Furthermore, the use of Google Analytics is based on your consent to the tracking of your surfing behavior on our websites and their analytical evaluation. We have also concluded an order processing contract.

The information generated by the cookie about your use of this website is generally transferred to a Google server in the USA and stored there. These cookies may contain the following information, for example IP address, number, date and time of the visit, duration of the visit, your access page from which you use the website (reference URL), the pages visited on our website, browser type/version and operating system used. 6.8. reCAPTCHA

We use the reCAPTCHA service from Google Inc (Google) to protect your requests via the Internet form. The query serves to differentiate whether the input is made by a human or abusively by automated, machine processing. The query includes sending the IP address and any other data required by Google for the reCAPTCHA service to Google. For this purpose, your input is transmitted to Google and used there. However, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. Google will use this information on behalf of the operator of this website to evaluate your use of this service. 6.9 YouTube

We have embedded YouTube videos in our website in order to present appealing content directly to you. YouTube is a video portal that has belonged to Google since 2006. It is operated by YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA. When you access a page with an embedded YouTube video, your browser automatically connects to YouTube servers. This connection may involve various data transfers. Google Ireland Limited is responsible for data processing in Europe.

The integration enables us to offer you videos and an optimized user experience. YouTube provides a code for this that we use on our website. This provides you with helpful content and optimizes the visibility of our site in search engines.

When you visit a page with an embedded YouTube video, YouTube sets at least one cookie that stores your IP address and our URL. If you are logged into your YouTube account, interactions on our site can be assigned to your profile. This data includes session duration, bounce rate, approximate location and technical information. Other data may include ratings, social media shares or adding to your favorites.

Users who are not logged in receive a unique identifier for device linking. The preferred language setting, for example, is saved. Some interaction data is not stored due to fewer cookies being set.

YouTube data is stored on Google servers, mostly in the USA. Your data is distributed to increase retrieval speed and security. Google stores data for different lengths of time, some can be deleted, others automatically after a certain period of time.

You can delete data in your Google account manually or use the automatic deletion function. You can delete or deactivate cookies to reduce data collection. We use the content delivery network Amazon CloudFront CDN. The provider is Amazon Web Services EMEA SARL, 38 avenue John F. Kennedy, L-1855, Luxembourg (hereinafter "Amazon"). Amazon CloudFront CDN is a globally distributed content delivery network. Technically, the information transfer between your browser and our website is routed via the content delivery network. This enables us to increase the global accessibility and performance of our website. 7. personal data abroad

We generally process personal data in Switzerland and the European Economic Area (EEA). However, we may also export or transfer personal data to other countries, in particular to process it or have it processed there. We only passively transfer personal data to third parties through the integration of plugins etc. We do not actively transfer any personal data to third parties.

We may export personal data to all countries and territories, provided that the legislation of the country in question or the international body - in accordance with a decision by the Swiss Federal Council - guarantees adequate data protection. Data may also be exported without a decision by the Federal Council as long as appropriate data protection is guaranteed by

  • An international treaty;
  • Data protection clauses in a contract between the controller or the client and its contractual partner, which have been communicated to the FDPIC in advance;
  • Specific guarantees drawn up by the competent federal body and communicated to the FDPIC in advance;
  • Standard data protection clauses that the FDPIC has approved, issued or recognized in advance;
  • Binding corporate rules on data protection that have been approved in advance by the FDPIC or by a data protection authority of a state that guarantees adequate protection; or
  • The Federal Council provides other suitable guarantees.

Data may also be exported abroad if the data subject has expressly consented to the disclosure or the disclosure is directly related to the conclusion or performance of a contract between the controller and the data subject or between the controller and its contractual partner in the interests of the data subject, or the disclosure is necessary for the protection of overriding public interests or the establishment, exercise or enforcement of legal claims before a court or other competent foreign authority. Disclosure is also permitted if it is necessary to protect the life or physical integrity of the data subject or a third party and it is not possible to obtain the data subject's consent within a reasonable period of time. In addition, the export of data abroad is permitted if the data subject has made the data generally accessible and has not expressly prohibited its processing or if the data can be found in a register provided for by law, which is public or accessible to persons with an interest worthy of protection, provided that the legal requirements for access are met in the individual case.

If and insofar as the General Data Protection Regulation (GDPR) is applicable, we may export data abroad as long as this country guarantees adequate data protection in accordance with the decision of the European Commission.
According to the decision of the EU Commission (2023/4745) of July 10, 2023 with regard to the so-called EU-U.S. Data Privacy Framework (DPF), it is now ensured that a data transfer to the USA receives protection equivalent to the EU/EEA area if the recipient is DPF-certified accordingly.

We may transfer personal data to countries whose law does not guarantee adequate data protection, provided that data protection is guaranteed for other reasons, in particular on the basis of standard data protection clauses or with other suitable guarantees (Art. 46 para. 2 GDPR). Standard clauses are templates provided by the EU Commission. By using them, the provider undertakes to comply with the European level of protection when processing personal data, even if the data is transferred to a country without adequate data protection. Even without such guarantees, the transfer of data may be permissible. This is particularly the case if the data subject expressly consents to the proposed data transfer after having been informed of the risks involved or if the transfer is necessary for the performance of a contract between the data subject and the controller or for the implementation of pre-contractual measures at the request of the data subject. Furthermore, admissibility may be given if the transfer is necessary for the conclusion or performance of a contract concluded by the controller with another person in the interest of the data subject. 8 Rights of data subjects

Data subjects whose personal data we process have the rights under Swiss data protection law and - if applicable - the General Data Protection Regulation (GDPR).

These include the right to free information about the processing, the origin, the storage period - or if this is not possible, about the criteria for determining the duration - and the respective purpose for processing their personal data, as well as the right to rectification, erasure, restriction of data processing, data portability or blocking of the processed personal data to the extent prescribed by law. Furthermore, data subjects have the right to information as to whether automated individual decisions have been made, as well as the logic on which the decisions are based. The right to information can only be restricted or postponed by legal restrictions.

Furthermore, data subjects who have disclosed personal data to InnoPlastics AG have the option of requesting such data - as long as it is processed automatically - in a commonly used electronic format.

Data subjects whose personal data we process can - if the General Data Protection Regulation (GDPR) applies - also request confirmation free of charge as to whether we process their personal data and, if so, request information about the processing of their personal data, have the processing of their personal data restricted, exercise their right to data portability and have their personal data corrected, deleted, blocked or completed. You can also withdraw your consent at any time with effect for the future and object to the processing of your personal data at any time.

Data subjects whose personal data we process have the right to lodge a complaint with a competent supervisory authority. The supervisory authority for data protection in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC).

 

9. data security

We take appropriate technical and organizational measures to ensure data security appropriate to the respective risk. Unfortunately, however, we cannot guarantee absolute data security.

Our website is accessed using transport encryption (SSL / TLS, in particular with the Hypertext Transfer Protocol Secure, abbreviated to HTTPS).

Access to our online offer is subject - as is generally the case with any Internet use - to mass surveillance without cause or suspicion and other surveillance by security authorities in Switzerland, the European Union (EU), the United States of America (USA) and other countries. We cannot directly influence the corresponding processing of personal data by secret services, police forces and other security authorities.

 

10 Notifications and messages

We send notifications and communications (e.g. newsletters) by email and, in some circumstances - if you provide us with other contact details - via other communication channels.

We will only send you communications if you consent to us sending you communications via, for example, your e-mail address, unless the use is permitted for other legal reasons. Wherever possible, we use the "double opt-in" procedure to obtain your consent, i.e. you will receive an e-mail with a web link that you must click on to confirm, to prevent misuse by unauthorized third parties.
